Do the Buyer and Seller Have to Use the Same Escrow Company?

A title company issues buyer's and lender's title insurance. The escrow holds the money and all of the important documents associated with closing. This is a much more streamlined way of getting it done. The buyer and seller can choose different escrow companies but typically use only one. More often, it is the title companies that differ. This is referred to as a "split closing."
A "split closing" means two title companies are involved in issuing the title insurance policies. This will occur when the seller and buyer prefer different companies. Under Section 9 of the "Real Estate Settlement and Procedures Act (RESPA)," sellers are not allowed to make using a specific title insurance company a condition of the sale. The buyer has the right to choose a title company to issue the policies. There are exceptions, of course. If the seller pays for both title insurance policies (owner and lender's), then the seller can use the title company of their choice, and vice versa.
